SMSF Setup & Establishment Services

SMSF setup is the legal and administrative process of establishing a self-managed super fund, appointing its trustees, putting the governing documents in place and registering the fund so it can operate. The sequence matters because a fund should be properly established before contributions, rollovers and investments are handled through it.

Financially Up can assist with the accounting and registration side of SMSF establishment and coordinate the practical setup steps. Deciding whether an SMSF is suitable for you can involve regulated financial product advice, which is separate from accounting and tax services and may require an appropriately authorized financial adviser.
Initial Discussion:If you are planning to set up an SMSF, an initial discussion can clarify the proposed members and trustee structure, the registration steps, what information is needed and whether legal or financial advice should be separately arranged.

What is involved in setting up an SMSF?

An SMSF is a superannuation fund that is managed by its members as trustees, or as directors of a corporate trustee. The members take responsibility for the fund's decisions and compliance obligations. Establishment therefore involves more than creating a bank account or completing an online registration.

The ATO setup process includes choosing the trustee structure, appointing eligible trustees, establishing the trust and deed, registering the SMSF, opening a unique fund bank account and preparing to receive contributions and rollovers.

Choose individual trustees or a corporate trustee

One of the first setup decisions is whether the SMSF will have individual trustees or a company acting as corporate trustee. The choice affects administration, ownership records, succession arrangements, ASIC obligations and establishment costs. It should be considered before the fund is registered and assets are acquired.

Individual Trustees Structure

Fund members act personally as trustees of the super fund. Generally suitable for funds seeking lower initial legal setup costs.

  • No ASIC company incorporation or annual company review fee
  • All asset titles must explicitly reflect the names of all individual trustees as trustees for the fund
  • Changes in membership require administrative updates on all fund bank and asset registries
Each member must personally sign the ATO trustee declaration.

Corporate Trustee (Special Purpose Company)

A registered Australian proprietary company acts as the trustee, with fund members acting as company directors.

  • Where a corporate trustee is used, the directors generally correspond with the fund members under the SMSF rules
  • Single-member SMSF funds can operate smoothly with a sole director/shareholder company
  • Simplified succession planning; changes in directors do not alter underlying legal title to assets
Company establishment and annual ASIC review fee apply.
Mandatory Director ID Requirement: Each proposed director must personally apply for a director ID before the fund is registered. Financially Up can explain the accounting and registration implications, but legal advice may be required for company or trust-deed matters outside our scope.

Members, trustees and eligibility

An SMSF can generally have up to six members. Subject to limited exceptions, members must also be individual trustees or directors of the corporate trustee. Trustees must be eligible to act and should understand that they remain responsible for the fund even when accountants, administrators or other professionals are engaged.

ATO Trustee Declaration (21-Day Statutory Window)

Each new trustee or corporate-trustee director must consent in writing and sign the ATO trustee declaration within 21 days of appointment. The declaration confirms their key responsibilities and must be retained while they remain in the role or for 10 years, whichever is longer.

  • Acknowledgment of the sole purpose test for retirement benefits
  • Understanding of investment restrictions, lending bans, and in-house asset limits
  • Retention of signed declaration for at least 10 years or duration of tenure
Must be signed within 21 days of appointment

Trust deed and legal establishment

An SMSF needs a trust deed that sets out the fund's rules and trustee powers within the superannuation-law framework. The fund also needs to be legally established, which includes holding assets for the benefit of members.

Trust deed preparation is a legal-document matter, soFinancially Up may coordinate with an appropriate legal document provider or legal adviser rather than presenting accounting assistance as legal advice.

Coordinated with accredited legal document providers

Register the SMSF for an ABN and TFN

Once the SMSF is legally established and the trustees have been appointed, the ATO states that the fund has 60 days to register by applying for an Australian business number. The registration process also covers the fund's tax file number and its election to be regulated as an SMSF.

Registration details need to be accurate because they are used by the ATO and by other super funds when processing rollovers. The fund may also need an electronic service address for Super Stream-related data messages. Delays or inconsistent trustee information can hold up registration and later rollovers.

Open a separate SMSF bank account

The fund needs a dedicated bank account, clearly identified as the SMSF account, for contributions, rollovers, investment earnings and fund expenses. It must remain separate from the personal or business assets of trustees and directors. Member entitlements are tracked through the accounting records rather than through separate bank accounts for each member.

  • Strict legal separation between fund monies and personal/business cash
  • Dedicated transaction tracking for member contributions and rollovers
  • Sub-accounts for members maintained internally in ledger accounting
Must be opened under the formal name of the trustees for the fund.

Rollovers and contributions should follow establishment

Rollovers should be approached after the fund is properly established and registered and its banking and electronic messaging details are ready. The receiving fund's details must be capable of being verified through the superannuation system.

A rollover does not give unrestricted access to super. SMSF money remains subject to preservation and condition-of-release rules, and illegal early access can have serious consequences.

SuperStream ESA validation required before initiating transfers

Important Superannuation Safeguard: Rollover money cannot be accessed for personal use, private loans, or living expenses. Withdrawing super without meeting a formal condition of release is illegal and attracts severe regulatory penalties, personal disqualification, and adverse tax rates.

SMSF setup fees and establishment costs

SMSF setup fees vary with the structure and work required. A corporate trustee generally has company-establishment and ongoing ASIC costs in addition to SMSF establishment work, while legal-document and specialist advice costs can also vary. We can confirm the service scope and applicable fees after reviewing the proposed setup.

Tax Treatment of SMSF Establishment Costs

For tax purposes, establishment costs need to be distinguished from ordinary ongoing administration costs. The ATO notes that costs incurred to establish an SMSF or make lasting structural changes are generally capital in nature and are not deductible under the general deduction rules. The treatment of a particular cost depends on what the expenditure is actually for.

What information is needed to set up an SMSF?

Having these 7 core details organized simplifies the establishment workflow and avoids delays with the ATO or banking providers:

1

Proposed fund name and intended members

Selecting the compliant legal fund name and confirming member identities (up to six members).

2

Full identification and tax details for each proposed member/trustee

Tax File Numbers (TFN), dates of birth, residential addresses, and certified photo ID documents.

3

The proposed individual-trustee or corporate-trustee structure

Confirmation of whether individual trustees or a dedicated proprietary corporate trustee will be established.

4

Director ID information where a corporate trustee is being used

Verified Australian Director Identification Numbers for all proposed corporate trustee directors.

5

Contact and address details for registrations

Principal place of business, formal registered office address, and primary contact details for ATO/ASIC registries.

6

Information needed for the fund bank account and electronic service address

Authorized bank signatory mandates and choice of SuperStream Electronic Service Address (ESA) provider.

7

Details of existing super funds if members later plan to request rollovers

Current superannuation fund names, member account numbers, and Australian Business Numbers (ABNs).

What happens after establishment?

Once established, the SMSF moves into ongoing administration. Trustees need to keep proper records, maintain the fund's investment strategy, record contributions and benefits, prepare annual financial statements, obtain an independent audit each year and lodge the SMSF annual return. Our SMSF accounting service can assist with the recurring accounting and tax work after setup.
