SMSF Compliance Services for Trustees

SMSF compliance means operating the fund in accordance with its trust deed, superannuation law and the reporting obligations that apply to self-managed super funds. Trustees are responsible for the fund’s decisions, even when accountants, administrators or advisers assist with the work.

Financially Up provides SMSF compliance support by reviewing accounting records, identifying transactions or documentation that may need attention, helping trustees prepare for annual accounting and audit, and coordinating tax and reporting work within our scope. We do not replace the trustees’ legal responsibilities, an independent SMSF auditor or regulated financial product advice.
Initial Compliance Review:If you are unsure whether your SMSF records or transactions are in order, an initial compliance review can help identify what should be checked before year-end, audit or lodgement.

What does SMSF compliance involve?

SMSF trustee compliance covers much more than lodging an annual return. Trustees need to maintain the fund for permitted retirement or death-benefit purposes, keep fund assets and money separate from personal or business assets, follow investment restrictions, document trustee decisions, maintain an appropriate investment strategy and meet annual accounting, audit and reporting requirements.

The exact compliance issues depend on what the fund owns and does. A simple cash-and-listed-investment fund may have a very different risk profile from an SMSF with property, an LRBA, related-party dealings or pension accounts.

Sole Purpose Test

Maintaining the fund strictly for the permitted purpose of providing retirement or death benefits to members or their dependants.

Separation of Fund Assets

Keeping all SMSF monies, titles, and bank accounts strictly separate from the personal or business assets of trustees and directors.

Investment Strategy Governance

Formulating, documenting, and regularly reviewing an investment strategy addressing risk, diversification, liquidity, and member insurance.

Statutory Reporting & Auditing

Fulfilling annual accounts preparation, independent compliance and financial audit, and timely SMSF annual return lodgement.

Trustee Legal Responsibility: Financially Up provides SMSF compliance support by reviewing accounting records, identifying transactions or documentation that may need attention, helping trustees prepare for annual accounting and audit, and coordinating tax and reporting work within our scope. We do not replace the trustees’ legal responsibilities, an independent SMSF auditor or regulated financial product advice.

Key areas reviewed in an SMSF compliance check

A methodical review examines the fund's records against statutory superannuation operating standards before accounting and independent audit:

1

Ownership and separation of SMSF assets from personal or business assets

Verifying all bank accounts, property titles, and investment portfolios are strictly registered under trustee names for the fund.

2

Whether investments are consistent with the fund’s trust deed and investment strategy

Testing actual portfolio asset weightings against authorized ranges documented in the fund's governing strategy.

3

Arm’s-length terms and market-value evidence for relevant transactions

Confirming commercial pricing, objective 30 June market values, and absence of preferential related-party advantages.

4

Related-party acquisitions, loans, leases and in-house asset considerations where applicable

Checking commercial real estate lease conditions, business real property exceptions, and the statutory 5% in-house asset limit.

5

Contribution, rollover and benefit-payment records

Validating personal contribution deductibility notices, work test declarations where required, and SuperStream rollovers.

6

Member balances, pension documentation and reporting where relevant

Checking transfer balance cap compliance, minimum annual pension drawdowns, and correct tax-free proportion splits.

7

Accounting records, trustee minutes and supporting documents required for annual audit

Ensuring all source invoices, bank statements, contract notes, and trustee resolutions are assembled for the auditor.

8

Outstanding lodgements, prior audit findings or unresolved ATO correspondence

Reviewing historical tax return lodgements, outstanding prior-year audits, and rectifying past auditor contravention reports.

Investment strategy and trustee decisions

An SMSF must have a written investment strategy that reflects the fund’s circumstances and is reviewed regularly. The strategy should address matters such as risk, diversification, liquidity and the ability to meet liabilities, and trustees must consider whether insurance should be held for members. The strategy should be a real governance document rather than a generic template that has no connection to the fund’s investments.

Where the fund makes a major change - for example, acquiring property, using an LRBA or moving heavily into one asset class - trustees should consider whether the investment strategy and supporting minutes need to be updated.

Risk & Return Profile

Balancing investment risk against expected returns to align with member retirement objectives.

Asset Diversification

Managing exposure across equities, cash, real estate, and fixed interest to minimize portfolio volatility.

Liquidity & Liability Matching

Ensuring adequate cash flow to pay fund expenses, tax liabilities, and mandatory pension minimums.

Member Insurance Consideration

Documenting formal consideration of whether life, TPD, or income protection insurance should be held for fund members.

Active Strategy Review Requirement: The ATO scrutinizes funds with high asset concentration (such as a single commercial property). Trustees must hold formal meetings and execute minutes documenting how high concentration aligns with liquidity needs and insurance requirements.

Related-party and arm’s-length issues

SMSF rules restrict transactions involving members, relatives and other related parties. Limited exceptions can apply, depending on the asset and arrangement. Transactions must be on arm's-length terms or, where the parties are not dealing at arm's length, the terms must not be more favorable to the other party than arm's-length terms. Related-party acquisitions, leases, loans and in-house assets can create compliance risk if not handled correctly.

Related-Party Dealings & In-House Asset Limits

Transactions involving members or associates must satisfy rigorous statutory exceptions:

  • Residential acquisitions from related parties are strictly prohibited
  • Loans to members or associates are expressly banned under super law
  • In-house assets (loans to related trusts/entities) must remain under 5% of total fund value

What if a compliance issue has already occurred?

The right response depends on the facts. A late document, incorrect transaction, related-party issue or breach of an investment restriction should not be hidden or casually reversed without understanding the consequences. Some matters may be correctable through documentation or transaction steps, while others may require disclosure, auditor reporting, legal advice or direct engagement with the ATO.

Financially Up can help review the accounting and tax position, reconstruct records where possible and coordinate the compliance work within scope. Where the issue requires legal advice, regulated financial product advice or specialist superannuation law input, we will distinguish that from our accounting and tax work.

Transparent, measured rectification protects fund compliance status.

Annual SMSF compliance obligations

Each income year, an SMSF generally needs annual accounts and financial statements, an independent financial and compliance audit, and an SMSF annual return. The approved SMSF auditor must be appointed no later than 45 days before the annual return due date, and the audit must be completed before lodgement.

Record Retention Rules:Trustees also need to keep appropriate records. Core accounting records and annual financial statements generally need to be retained for at least five years. The trust deed, trustee minutes, investment-strategy records, member and trustee changes, consents and other specified governance records generally need to be retained for at least 10 years. The applicable period depends on the document.
