What should you do if your BAS is overdue?
The practical first step is to confirm the overdue periods and avoid guessing the figures. A BAS can include GST, PAYG withholding, PAYG instalments and other obligations depending on the business. If the bookkeeping is incomplete, the BAS should generally be prepared from corrected records rather than lodged with unsupported estimates simply to clear the overdue status.
The ATO expects activity statements to be lodged on time even when there is nothing to report or the business is having difficulty paying. A nil BAS may still need to be lodged where the business has a lodgment obligation but no reportable amounts for the period. This means a cash-flow problem is not, by itself, a reason to leave the BAS unlodged.
Confirm Exact Overdue Periods
The practical first step is to confirm the overdue periods and avoid guessing the figures. A BAS can include GST, PAYG withholding, PAYG instalments and other obligations depending on the business.
Base Returns on Reconstructed Records
If the bookkeeping is incomplete, the BAS should generally be prepared from corrected records rather than lodged with unsupported estimates simply to clear the overdue status.
Nil BAS Still Mandatory
The ATO expects activity statements to be lodged on time even when there is nothing to report. A nil BAS may still need to be lodged where the business has an active obligation but zero reportable amounts.
Cash-Flow Does Not Excuse Non-Lodgement
Cash-flow difficulty is not, by itself, a reason to leave activity statements unlodged. Lodging accurately locks in the correct figures so payment plans can be arranged.
Why do BAS lodgments become overdue?
Common causes include unreconciled accounts, incomplete sales or expense records, payroll differences, uncertain GST coding and inactive periods where registrations remained open.
Unreconciled Bank & Card Feeds
bank and credit-card transactions have not been reconciled for several months or quarters
Incomplete or Inconsistent Records
sales or expense records are incomplete, duplicated or coded inconsistently
Payroll & PAYGW Discrepancies
payroll and PAYG withholding figures need to be reconciled before the BAS is prepared
Dormant Registrations Left Open
the business stopped trading but GST or other registrations were not reviewed
Tax Debt Avoidance
the owner avoided lodging because they expected a tax debt they could not pay immediately.
How does a BAS catch up service work?
A catch-up engagement is normally handled in stages so the figures remain traceable and later periods are not built on incorrect opening balances. Financially Up may first review the ATO activity statement history, accounting file, bank reconciliations and payroll records. We then identify the missing work and prepare the overdue periods in sequence.
Audit Lodgement History
confirm which activity statements are outstanding and whether any periods have already been lodged or ATO-finalized
Reconcile Bookkeeping
bring bookkeeping and reconciliations up to date where necessary
Technical Tax & GST Review
review GST coding, sales, purchases, payroll and other BAS labels relevant to the business
Preparation & Client Approval
prepare each overdue BAS using the available records and obtain client approval for lodgment
Sequential Lodgement
lodge the outstanding statements and review the resulting ATO account position
Debt & Penalty Separation
identify any further debt, penalty, payment-plan or registration work that should be handled separately.
Overdue BAS and ATO penalties
A failure-to-lodge-on-time penalty can apply when an activity statement is lodged after its due date. The ATO states that it generally considers the circumstances and does not necessarily apply a penalty in every isolated late-lodgment case. If a penalty is imposed, the ATO notifies the taxpayer. The amount can vary with factors such as entity size and how long the document has been overdue.
Penalty remission may be available in some circumstances, but it is not automatic and should not be assumed before the facts are reviewed. Financially Up can help identify the relevant circumstances and communicate with the ATO within scope if a remission request is appropriate.
How FTL Penalties are Calculated on BAS
Penalty Units & Time Accrual
FTL penalties accrue per 28-day period (or part thereof) that the activity statement remains unlodged, up to a statutory maximum of 5 penalty units for small entities.
Entity Multipliers (Medium & Large Businesses)
The penalty is multiplied by 2 for medium entities (assessable income $1M–$20M) and multiplied by 5 for large entities, making prolonged unlodged BAS backlogs costly.
Discretionary Remission Grounds
The ATO may remit penalties if late lodgment was caused by unforeseen natural disasters, illness, system failures, or reasonable care was exercised.
What if you cannot pay the BAS debt?
Lodgment and payment are separate obligations. It can still be important to lodge an accurate BAS even when the full amount cannot be paid immediately. Once the activity statements are up to date, the actual account balance is clearer and payment options can be considered on the correct figures.
Amounts that remain unpaid after their due date generally attract general interest charge, calculated daily on a compounding basis. If overdue BAS has created or increased an ATO debt, our ATO debt service can address the debt and payment side separately. A standard payment plan does not stop GIC from accruing and does not remove the need to keep future lodgments and payments current.
Lodgement vs Payment Separation
Lodgment and payment are separate obligations. It can still be important to lodge an accurate BAS even when the full amount cannot be paid immediately. Once the activity statements are up to date, the actual account balance is clearer and payment options can be considered on the correct figures.
Daily Compounding Interest (GIC)
Amounts that remain unpaid after their due date generally attract general interest charge, calculated daily on a compounding basis. (Note: from 1 July 2025, newly incurred GIC is no longer tax deductible).
Ongoing Compliance Conditions
A standard payment plan does not stop GIC from accruing and does not remove the need to keep future lodgments and payments current. New quarterly BAS liabilities must be funded separately.

What records does a late BAS accountant need?
Useful records can include bank and credit-card statements, accounting software access, sales and supplier invoices, point-of-sale reports, payroll and Single Touch Payroll records, prior BAS, loan statements and details of unusual transactions. Additional invoices or contracts may be needed where GST treatment is uncertain.
If the records are incomplete, a bookkeeping clean-up may be required before the BAS can be prepared reliably. Our bookkeeping service can bring the accounting records up to date, while this page focuses on the activity statements and related ATO lodgment position.

Overdue BAS versus normal BAS lodgement
A standard BAS lodgement service usually covers a current period supported by up-to-date bookkeeping. Overdue BAS work may require historical reconstruction, multiple reconciliations and review of earlier periods. Once the backlog is cleared, ongoing BAS support can help keep future statements on schedule.
Normal Quarterly BAS Lodgement
- Covers single current quarter with live up-to-date bank feeds.
- Lodged under standard 4-week agent extension deadlines.
- Routine cash flow planning with zero accumulated GIC interest.
Historical Overdue BAS Catch-Up
- Requires multi-period reconstruction and ledger forensic review.
- Addresses active ATO warning notices, default assessments and FTL risks.
- Integrates with subsequent ATO debt and payment plan negotiations.
When ATO activity statements have already been finalized
Single Touch Payroll amounts may already appear on an activity statement as ATO processed, or the statement may have been finalized in ATO systems. Review the history before lodging. The ATO says incorrect PAYG withholding on a finalized statement should be revised; if it is not finalized, the figures can generally be edited when lodging.

Yes, lodgment and payment are separate issues. An accurate activity statement can still be lodged even if the resulting amount cannot be paid in full immediately. Payment options can then be considered based on the actual ATO account balance.
