How Is Cryptocurrency Taxed in Australia?
For many Australian individuals holding crypto as an investment, cryptocurrency is generally a CGT asset. A capital gain or capital loss may arise when a CGT event happens. Different treatment may apply when crypto is received as income or held as part of a business.
Crypto as an Investment (CGT Asset)
Capital Gains Tax RegimeFor an investor, holding Bitcoin, Ethereum, Solana or other digital tokens is treated under the Capital Gains Tax provisions of the Australian tax legislation.
Every sale, crypto-to-crypto swap or commercial spend triggers a CGT event. Holdings held longer than 12 months may qualify for a 50% CGT discount.
Crypto Trading Business
Ordinary Income & Trading StockFrequent transactions or a large portfolio do not, by themselves, establish a crypto-trading business. Classification depends on your purpose, organization, repetition and the commercial nature of the activity. Where a business is carried on, crypto may be trading stock and gains may be ordinary income.
Significant capital commitment, business plan, systematic charting/bots, dedicated commercial premises, and active inventory management.
Which Crypto Transactions Have Tax Consequences?
Under ATO rules, disposing of digital currency encompasses far more than withdrawing funds back to an Australian bank account.
Fiat Conversions
Sell crypto for Australian dollars or another fiat currency
Crypto-to-Crypto Swaps
Swap one crypto asset for another (e.g. BTC to ETH or USDT)
Purchasing Goods/Services
Use crypto to buy goods or services from a merchant
Gifting & Transfers
Gift crypto to another person or transfer ownership
Crypto-to-Crypto Swaps
A crypto-to-crypto swap generally involves disposing of one asset and acquiring another. The Australian-dollar market value at the time is usually needed, even if no cash changes hands.
Wallet-to-Wallet Transfers
Moving crypto between accounts you beneficially own is generally not a disposal merely because its location changes. Keep evidence linking both sides. Fees paid in crypto and changes in beneficial ownership may have separate consequences.
Crypto Capital Gains, Losses and Personal-Use Assets
Navigating cost-base adjustments, loss quarantining, the 12-month 50% CGT discount, and the strict conditions of the personal-use asset exemption.
Calculating Gains & Losses
For an investor, a gain or loss is generally worked out by comparing capital proceeds with the asset's cost base or reduced cost base. The cost base may include acquisition and eligible transaction costs. A market-value rule may apply where there are no cash proceeds.
Capital Loss Application
Capital losses can generally reduce capital gains but not salary or other ordinary income. Unused net capital losses may be carried forward. Eligible individuals may be entitled to the CGT discount for assets held for at least 12 months, after applying capital losses and subject to the relevant conditions.
12-Month Holding Discount
Individuals who hold crypto tokens for at least 12 months before disposal are generally entitled to a 50% CGT discount on any net capital gain, calculated after applying current and prior-year capital losses.
Personal-Use Asset Rule
The personal-use asset exception is narrow. It depends on crypto being kept or used mainly to buy items for personal use or consumption-not merely on eventually spending an investment. A gain on a qualifying asset acquired for less than $10,000 may be disregarded; losses from personal-use assets are disregarded.
Staking Rewards, Airdrops and Other Crypto Income
Digital asset returns often generate dual tax obligations: assessable income upon receipt, followed by capital gains calculations on future disposals.
Staking Rewards
Staking rewards may be ordinary income when derived, depending on the arrangement. A later sale or swap may also have CGT consequences.
Airdrops & Token Allocations
Airdrops do not all receive identical treatment. Tokens received for services, promotion or another income-producing activity may be ordinary income at market value when derived. Other arrangements can differ. An amount included as income may also affect the asset's later cost base.
Crypto for Work or Business
Crypto received for work or business sales may be assessable income, subject to ordinary Australian income tax rates at fair market value.
DeFi, Wrapping & Liquidity Pools
DeFi, wrapping, liquidity and other smart-contract arrangements require review of their legal and practical effect.
Records for a Crypto Tax Return
Australian tax legislation requires complete documentation for every acquisition, transfer, and disposal across all exchanges and on-chain wallets.
Complete Transaction History Required
Statutory Records ChecklistKeep a complete transaction history showing:
5-Year Statutory Retention
Records generally need to be kept for five years after the relevant disposal, with longer retention where they establish the cost base of assets still held. Reconcile data from multiple or foreign platforms.
Handling Incomplete Records
If records are incomplete, Financially Up can identify gaps and explain what further information may be needed. Not every missing transaction can necessarily be reconstructed.
